Studio Policy
By booking a session and accepting our services you are offering to purchase our services on and subject to the following terms and conditions.
In order to contract with Cybil Louie Photography LLC you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Cybil Louie Photography LLC retains the right to refuse any request made by you. When booking a session you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the costs. All prices advertised are subject to changes without notice.
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur.
SESSION FEE
Included in your session fee are:
• Consultation: To discuss how you would want to be photographed and to arrange clothes and style
• Complete access to our wardrobe during the photo shoot
• Up to two hours of studio shooting
• Ordering session: The viewing of your photographs at the studio or online
• Completely guided posing and expressing instruction
• The time, effort and skill of the photographer
Your session fee DOES NOT include any digital or printed deliverables. The session fee must be paid upon booking. The Parties/Client recognize that the Session Fee is non-refundable in the case of cancellation by the Client; however, we will accept a one-time rescheduling of your session date up to 14 days prior to your scheduled session. Rescheduling with less than 14 days' notice will incur a $199 fee.
CREATIVITY MANAGEMENT
The Photographer maintains artistic control of the session. This control includes the adjustment of hair, cosmetics, jewelry, clothes, and garment straps, but is not restricted to these items.
USAGE OF INDEPENDENT CONTRACTORS
If a Client brings her own hair stylist/makeup artist (Independent Contractors), the Photographer and Cybil Louie Photography LLC are not responsible for any application, services, or liability insurance provided by the Client's hair stylist/makeup artist. This includes, but is not limited to, allergies caused by the hair stylist or makeup artist's usage of the materials. It is the Client's responsibility to inform the Independent Contractor of any allergies.
If a Photographer provides a hair stylist/makeup artist, the Photographer is not responsible for the application or services provided by this Independent Contractor. This includes, but is not limited to, allergies caused by the Independent Contractor's usage of the items. It is the Client's responsibility to inform the Independent Contractor of any allergies.
PRODUCTS/ PRINTS/DIGITAL FILES DELIVERY
It will take two to three weeks to retouch and distribute digital files (depending on the number of images ordered). Prints and photo products will be sent according to the vendor's delivery schedule. Cybil Louie Photography LLC is not liable for any kind of delay.
All ordered photos are stored on file for one year. All un-ordered photos are deleted after 30 days.
PHOTO ORDERING
Once an order has been placed and paid for in-person or online, it cannot be altered or cancelled. We DO NOT provide online ordering galleries. Digital files cannot be delivered to the Client until FULL payment has been received.
DIGITAL DOWNLOADS
After payment verification, your files will be accessible for download. Digital downloads such as Digital Overlays, Online Courses/Workshops, etc. are not eligible for returns, exchanges, or cancellations.
PAYMENTS
A non-refundable session fee is payable at the time the photo shoot is scheduled. Before ordering any digital files, prints, or picture items, the total amount must be paid. We do not provide in-house payments plan.
Cash, Venmo, Zelle, or PayPal are acceptable payment methods.
ONE THE DAY OF YOUR APPOINTMENT
On the day of your session, only participants in the photo session are permitted to enter the studio. No visitors are permitted.
100% SATISFACTION
Cybil Louie Photography LLC prides on producing excellent portraits. You are not required to purchase any digital or print photographs if, for whatever reason, you do not like any of them. There will be no charge for professional editing services.
A session fee cannot be refunded.
THE COPYRIGHT
The Copyright Act of 1976 grants the photographer ownership of the photos. The Copyright Act of 1976 protects any pictures or copies of images, whether saved digitally or otherwise, as well as any computer program, including source or object code, computer files, or printed documentation pertaining to such images.
Client accepts that, subject to the rights and licenses provided herein, Cybil Louie Photography LLC is and shall remain the sole and exclusive owner of all worldwide rights, titles, and interests in and to the Photos and any copies thereof. All rights and licenses not expressly granted by this Agreement are reserved by Cybil Louie Photography LLC.
The rights indicated herein are exclusive to the CLIENT and may not be transferred to any other agent or corporation, parent company, affiliates, or subsidiaries. This agreement grants the Client the limited right to reproduce, publicly display, and distribute the Photos ONLY for noncommercial personal use.
It is a violation of the Act to copy or permit the copying of a picture made as part of this contract by photographic/electronic or other methods without the written authorization of The Photographer.
INDEMNITY AND LIABILITY
Photographer(s) will at all times carry Public Liability and Professional Indemnity insurance. In the unusual case of a total photographic failure or cancellation of this Contract by either party, or in any other condition, the responsibility of one party to the other shall be limited to the whole Contract value.
Neither party is responsible for indirect or consequential damages.
THE USE OF PERSONAL CAMERAS
Personal cameras/video camera are not permitted during your studio session. We work extremely hard to ensure that your session is artistically documented. We request that you respect our livelihood and abstain from photographing or filming our work.
LOCATION OF THE STUDIO
The studio is located on the third floor. Please inform us before booking the photo session if you are unable to climb the stairs.
COVID-19 STRATEGY
For your personal safety, if anybody (photographer, photographer's helpers, hair stylist, or makeup artist) has Covid-19, we will immediately cancel the session.
If you have a signs of COVID-19, please call us immediately.
At your arrival, you will have access to soap and hand sanitizer or wash your hands.
During the photo session, the photographer might not wear a facemask and gloves. Please contact us if you have any concerns before the session.
MODEL RELEASE
You may ask to sign a model release, since I frequently utilize photographs for my website, social media, and educational purposes, including online or in-person workshops/courses. If you do not wish for your photographs to be shown, please let us know.
LEGAL SYSTEM AND JURISDICTION
The parties irrevocably agree that any disagreement or claim arising out of this agreement shall be governed by and interpreted in accordance with Virginia law, and that the courts of Virginia shall have exclusive jurisdiction to determine any such dispute or claim.
